Abstract
In recent years, India's environmental justice system has seen a significant shift, as there has been a rise in knowledge regarding the true relevance of environmental protection and a continual and quick expansion in the number of environmental courts and tribunals. This study will largely examine the origins of the National Green tribunal and how it influences the variables that contribute to environmental justice. This is a study of the leading case laws and precedents that have led to the current situation of India's environmental legislation. The purpose of this research paper is to demonstrate the significance and rationale behind the establishment of the National Green Tribunal in India. The study will also examine the Green Tribunal's primary and secondary goals and characteristics, as well as when and how these characteristics are deployed to accomplish environmental justice. In doing so, this paper will not only provide a detailed analysis of the major case laws of India's environmental laws, but it will also shed light on the significant difference made by the Green Tribunal in the field of environmental law and how its rules and regulations will provide security for future environmental injustice issues. This article will also discuss the Green Court's key elements, jurisdiction, and jurisdictional power, as well as how the tribunal might strengthen its position in the Indian Legal System in order to provide better and more expedient environmental justice.
