Abstract

Equitable compensation is a remedy which may be ordered following a breach of trust. Although the ability to grant this remedy survived the merger of common law and equity, it was, however, rarely used. Generally it was a historically obscure remedy, but this situation has changed in recent years. The superior courts in the UK seized this opportunity to develop a unique jurisprudence on this remedy.
