Abstract

This study is aimed at analysing the unique Indonesian method of foreign investment in mining known as the Contract of Work system. It started off as a coherent way of looking at benefits to both parties - the investor and the host country - with the major factors of security of tenure and lex specialis method of ensuring that taxation and other regulations remained constant. Those factors were changed thus undermining the system and led to the decline in foreign investment. Simultaneously, the general breakdown of social rules because of the lack of regional development resulted in further disincentives for miners to even stay operating. Illegal miners occupied operating mines and exploration areas with the government forces failing to stop this. The creeping demands put on the foreign investing community by way of taxation and royalty payments were further disincentives to foreign investment.
